PARKING USE AND OPERATION REGULATIONS OF VARA VARA AQUACITY PARKING

This Regulation is a public offer issued by "Vara Vara Club" S.R.L., IDNO 1022600013542, with its legal address at: Chisinau, Riscani sector, Grigore Vieru Blvd 22/8, apt. (office) 10 (hereinafter referred to as "Vara Vara Aquacity Parking"), acting as the trusted administrator of IBIZA CLUB S.R.L., IDNO 1015600022904, with its legal address at: Chisinau, Decebal Blvd 6/4 (hereinafter referred to as "IBIZA CLUB"), located at: Mihail Sadoveanu Street 4/2, Chisinau. This Regulation establishes the terms of access to the parking, its usage rules, and the rights and obligations of the parties.The acceptance of the public offer is carried out by the User receiving a parking ticket upon entry. These actions, accompanied by the opening of the barrier and entry to the parking, signify the User's unconditional agreement with the terms of this Regulation and are equivalent to the conclusion of the service agreement for parking vehicles in accordance with the Civil Code of the Republic of Moldova.The parking lot, related to Vara Vara Aquacity, is a privately owned property belonging to IBIZA CLUB, with regulated public access. The laws of the Republic of Moldova on private property protection, road traffic, and specific rules regulating the activity of private parking lots apply.The parking lot is intended for use by visitors in accordance with the provisions of this Regulation. Parking is allowed for the period of actual parking, with hourly rates applied when necessary.Access is allowed only if there are available parking spaces.Movement within the parking lot, as well as stopping or parking vehicles, must be done in compliance with the road markings and all signs or instructions placed by Vara Vara Aquacity Parking. It is prohibited to drive against the direction indicated by the signs, as well as stopping outside the designated zones.Vara Vara Aquacity Parking and/or IBIZA CLUB may temporarily restrict access to the parking lot completely or partially for technical, administrative, safety reasons, in case of non-compliance with the provisions of this Regulation, or when there are justified obstacles to the use of the parking lot, without any obligation to provide prior or subsequent notice and without the obligation to compensate any direct or indirect damages arising from the User's inability to use the parking lot.Vara Vara Aquacity Parking and IBIZA CLUB do not guarantee the constant availability of parking spaces, and the absence of available spaces does not constitute grounds for compensation or reimbursement of losses.

RATES AND PAYMENT TERMS

Day rate (10:00–22:00): No night rate: access is prohibited.Grace period: 15 minutes from the payment until the vehicle exits the parking lot.It is mandatory to keep the parking ticket until the exit and to scan it at the exit terminal.Parking rates may be changed by Vara Vara Aquacity Parking at any time without prior notice, depending on commercial policy, operational conditions, or other relevant circumstances. New rates take effect only after being posted in a visible location at the parking lot. The User is obligated to familiarize themselves with the current rates before using the parking.Parking time is calculated from the moment the ticket is issued until the parking fee is paid at the exit terminal. Any started time period is considered complete and must be paid in full, even if a shorter period was actually used.Refunds for erroneous payments can be made based on a written application with proof of payment within 15 calendar days from the payment date. The application should be sent via email to info@aquacity.md or submitted personally at the Vara Vara Aquacity Parking office.The owner of the vehicle is considered the responsible party for payment of parking services, unless they can document (statement, free-use agreement, acceptance act) that another person was using the vehicle at the time of entering the parking lot.

PARKING RULES

RESPONSIBILITIES OF THE PARTIES

The administrator of Vara Vara Aquacity Parking is only responsible for damages caused to vehicles, property within them, or individuals on the parking lot premises, to the extent that the damage is proven to be a direct result of actions or inactions attributable to the administrator or their staff.Vara Vara Aquacity Parking and IBIZA CLUB are not responsible for damages, losses, thefts, acts of vandalism, or other losses caused by third parties, external factors, weather conditions, force majeure, or other circumstances beyond their direct control.Parking users are obligated to ensure the safety of their vehicles and personal property and to comply with the internal parking usage rules established in this Regulation.By using the parking lot, the User confirms that they are familiar with and fully accept the conditions of this Regulation.

BEHAVIOR AND SAFETY

VIDEO SURVEILLANCE AND DATA PROTECTION

The parking lot is under 24/7 video surveillance using a monitoring system set up to protect the parking equipment.The video surveillance system automatically records the entry and exit of vehicles, as well as general behavior of Users within the parking lot.Video recordings are stored for no less than 72 hours and may be kept longer in justified cases, such as incident investigations or upon request from competent authorities.The collected data is processed in accordance with Law No. 133/2011 on personal data protection and other applicable regulations.By using the parking lot, the User gives their unconditional consent to the processing of the mentioned personal data.

SANCTIONS AND FINAL PROVISIONS

This Regulation is posted in an accessible and visible location at the parking lot premises and is also available online and/or via a QR code.Any inquiries, complaints, or requests related to parking services can be sent via email to info@aquacity.md. Responses to inquiries are provided within 15 working days.The administration reserves the right to restrict access to the parking lot in case of repeated violations of this Regulation by the User, namely at least two times.Illegal or improper parking, including blocking driveways, parking in prohibited areas, or abusing parking spaces, may result in sanctions by competent authorities in accordance with applicable laws.Any disputes arising from the use of the parking lot, the application or interpretation of this Regulation, shall be resolved amicably, and if no agreement is reached, they shall be settled in the competent courts of Chisinau Municipality.This Regulation may be periodically reviewed, and any changes take effect from the moment they are publicly posted on the parking lot premises.
